Water tariff rate for 2010 TTW used for billing to PWA

- Translation - TTW/039/10 20 January 2010 Subject: Notification of water tariff rate for 2010 used for billing to Provincial Waterworks Authority Attention: President of The Stock Exchange of Thailand Regarding to the Water Sale Purchase Agreement ("WSPA"), and the amendment agreement of the WSPA, between Thai Tap Water Supply Public Company Limited ("the Company") and the Provincial Waterworks Authority ("PWA"), water tariff rate will be adjusted each year on 1 January. The Company hereby informs the water tariff rate used for billing to PWA in 2010 (from 1 January to 31 December 2010) as follow:- 1. The water tariff rate for sale volume less than 300,000 cubic meter per day calculated from the formula in the WSPA is Baht 24.711331 per cubic meter (excluding VAT). However, in 2010, the Company has considered to give a discount of Baht 0.25 per cubic meter (excluding VAT) to PWA. Therefore, the water tariff rate of sale volume less than 300,000 cubic meter per day in 2010 is Baht 24.461331 per cubic meter (excluding VAT). 2. The water tariff rate for sale volume above 300,000 cubic meter per day are as follow:- 2.1. From 1 January 2010 until earlier of one day before the starting date of selling additional water under the amendment agreement of the WSPA, or 18 October 2010, the water tariff rate is Baht 9.784532 per cubic meter (excluding VAT). 2.2. From earlier of the starting date of selling additional water under the amendment agreement of the WSPA, or 19 October 2010, until 31 December 2010, the water tariff rate is Baht 10.75 per cubic meter (excluding VAT).
