TTW's 2009 water tariff and PTW's updated on dividend policy

(Translation) TTW/0041/09 22 January 2009 Subject: Water charge rate for 2009 of Thai Tap Water Supply Public Company Limited and progress of dividend restriction amendment of Pathum Thani Water Company Limited Attention: President The Stock Exchange of Thailand Thai Tap Water Supply Public Company Limited ("Company") would like to notify that the water charge rate for 2009 will be billed to Provincial Waterworks Authority ("PWA") and progress of dividend restriction amendment in concession of Pathum Thani Water Company Limited ("subsidiary"). The key aforementioned information is presented below:- 1. Reference is made to Water Sale and Purchase Agreement between the Company and PWA. Water charge rate will be adjusted on 1 January each year. The annual water charge rate for 2009 (applicable from 1 January to 31 December 2009) will be as follow:- 1.1 The water charge rate for treated water sale less than 300,000 cubic meter per day is Baht 23.552023 per cubic meter, excluding value added tax. 1.2 The water charge rate for treated water sale which is higher than 300,000 cubic meter per day is Baht 9.420809 per cubic meter, excluding value added tax. 2. The subsidiary received an add addendum of amendment to the concession from the concession grantor. The condition previously stipulated that the subsidiary makes dividend payments of not exceeding 10% of its paid-up capital. The new condition stipulates that the subsidiary makes dividend payments from its net profit only after it has set aside a statutory reserve equal to 10% of its annual net profit.
